These Terms of Service ("Terms") govern your access to and use of the website located at fobotechnologies.co.ke (the "Site"), operated by FOBO Technologies Ltd, a company company registered and incorporated in the Republic of Kenya ("FOBO", "we", "us", "our").
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site. These Terms apply to the marketing website only. Use of the FOBO Control application is governed by a separate FOBO Control Terms of Service , which takes precedence for that product where the two conflict.
The Site provides information about FOBO's products and services, including FOBO Control and FOBO Core Banking, and allows visitors to request demonstrations, contact our team, or apply to join a product beta. The Site does not itself process payments, move money, or store financial account data, those functions are performed exclusively within FOBO Control under its own Terms of Service.
The Site is intended for businesses, SACCOs, cooperatives, and individuals evaluating FOBO's products on their behalf. You must be at least 18 years old and have the authority to bind the organization you represent, where applicable, to use the Site's contact and demo-request features.
All content on the Site - including text, graphics, logos, product names, screenshots, and underlying code - is owned by FOBO Technologies Ltd or its licensors and is protected by Kenyan and international intellectual property law. You may view and print pages for personal, non-commercial reference. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written consent.

The Site may reference or link to third-party services, including Safaricom's M-Pesa platform, social media pages, and partner websites. We do not control and are not responsible for the content, terms, or practices of third-party services. Your use of those services is governed by their own terms.
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the maximum extent permitted by Kenyan law, FOBO Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the laws of Kenya, including liability for death, personal injury, or fraud caused by our negligence.
You agree to indemnify and hold harmless FOBO Technologies Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Kenya. Any dispute arising from these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts of Kenya, or referred to arbitration in Nairobi under the Arbitration Act, 1995, at either party's election.
